These terms and conditions outline the rules and regulations for the use of National Lifeline Association’s Website.
By accessing https://nalalifeline.org/ (hereafter referred to as ‘the Site’) we assume you accept these terms and conditions in full. Do not continue to use the Site if you do not accept all of the terms and conditions stated on this page.
The following terminology applies to these Terms of Service, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers
to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of United States. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Subject to applicable laws, National Lifeline Association, in its sole discretion, reserves the right to modify, alter or otherwise update these Terms at any time. Such modifications shall be effective immediately upon posting of the modified Terms. You should review these Terms regularly as they may change at any time at our sole discretion. By accessing and using the Site after we have posted notice of such modifications, alterations or updates, you agree to be bound by the revised Terms. If you do not agree to any term or condition, you should not access or otherwise use this Site.
Unless otherwise stated, National Lifeline Association and/or it’s licensors own the intellectual property rights for all material on National Lifeline Association. All intellectual property rights are reserved. You may view and/or print pages from the Site for your own personal use subject to restrictions set in these terms and conditions.
You must not:
- Republish material from the Site
- Sell, rent or sub-license material from the Site
- Reproduce, duplicate or copy material from the Site
- Redistribute content from National Lifeline Association (unless content is specifically made for redistribution).
i. Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means.
ii. Engaging in any activity that disrupts or interferes with our Resources, including the servers and/or networks to which our Resources are located or connected, is strictly prohibited.
iii. Attempting to copy, duplicate, reproduce, sell, trade, or resell our Resources is strictly prohibited.
iv. You are solely responsible any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.
v. We may provide various open communication tools on our website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the Resources posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. Impersonates any person or entity, including any National Lifeline Association employees or representatives.
We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
vii. You agree to indemnify and hold harmless National Lifeline Association and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
RESERVATION OF RIGHTS
We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. You agree to immediately remove all links to our Web site upon such request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuing to link to our Web site, you agree to be bound to and abide by these linking terms and conditions.
LIMITATION OF WARRANTIES
By using our website, you understand and agree that all Resources we provide are “as is” and “as available”. This means that we do not represent or warrant to you that:
i. the use of our Resources will meet your needs or requirements.
ii. the use of our Resources will be uninterrupted, timely, secure or free from errors.
iii. the information obtained by using our Resources will be accurate or reliable, and
iv. any defects in the operation or functionality of any Resources we provide will be repaired or corrected.
Furthermore, you understand and agree that:
v. any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
vi. no information or advice, whether expressed, implied, oral or written, obtained by you from National Lifeline Association or through any Resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.
LIMITATION OF LIABILITY
In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. National Lifeline Association will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.
PROPRIETARY RIGHTS – COPYRIGHTS.
All of the content included on the Site, including all materials, software, HTML or other code, documents, text, designs, graphics, logos, images (including photographs) audio and video (hereafter referred to as ‘Resources’) is the property of National Lifeline Association, or is being used by National Lifeline Association with permission, and is protected by United States copyright laws. You agree not to use, distribute, transmit, transfer, modify, perform, publish, display, license, reproduce, duplicate, copy, sell, resell, translate, exploit or created derivative works of the Resources for any commercial purpose. None of the Resources may be reverse-engineered, disassembled, decompiled, transcribed, resold, redisplayed or redistributed without National Lifeline Association’ specific prior written consent. National Lifeline Association grants you a limited license to access, view and use the Site, and to print individual pages of the Site for your own personal, noncommercial use, provided that you accept the terms and conditions set forth in this Agreement, and acknowledge that you do not acquire any ownership rights by using or downloading the Resources. Additionally, some material included on the Site is copyrighted by third parties, and you may not use, modify, copy, distribute, transmit, display or reproduce any of this third-party content without the prior written consent of National Lifeline Association. PROPRIETARY RIGHTS – TRADEMARKS.
Any trademarks, service marks, and logos (the “Trademarks”) used and displayed on the Site are the property of National Lifeline Association or other third parties. Users are not permitted to use these Trademarks without the prior written consent of National Lifeline Association or such other third parties. Nothing on the Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark, without the prior written permission of National Lifeline Association. National Lifeline Association prohibits the use of any of its logos as part of a link to or from any website, unless such link is approved in advance by National Lifeline Association in writing. Further, the design and layout of the Site is protected as National Lifeline Association’s trade dress and may not be copied or imitated in whole or in part.
